These Terms & Conditions (“Terms”) govern transportation, tour, excursion, reservation, and related services provided by Exclusive Transportation of Hawaii LLC dba ETOHI (“ETOHI,” “we,” “us,” or “our”).

By making a reservation, submitting payment, electronically accepting these Terms, or using ETOHI services, the Booking Party and each Passenger agree to these Terms to the fullest extent permitted by applicable law.

1. DEFINITIONS

1.1 ETOHI “ETOHI” means Exclusive Transportation of Hawaii LLC dba ETOHI and, where applicable, its authorized employees, drivers, contractors, and service personnel acting within the scope of their duties.

1.2 Passenger “Passenger” means any individual who is transported or scheduled to be transported by ETOHI. “Passengers” means two or more individuals transported or scheduled to be transported under a reservation or booking.

1.3 Booking Party “Booking Party” means the individual or entity making, arranging, or paying for a reservation, whether for themselves or on behalf of one or more Passengers. The Booking Party is responsible for providing accurate reservation information and communicating applicable booking requirements and these Terms to all Passengers included in the reservation.

2. RESERVATIONS & BOOKING

ETOHI services are subject to availability and are not confirmed until ETOHI accepts the reservation and provides confirmation. The Booking Party must provide accurate and complete information reasonably necessary to provide the requested service, including, as applicable:

  • Number of Passengers
  • Passenger information reasonably required for the service
  • Pickup location
  • Destination or itinerary
  • Date and time
  • Requested service duration
  • Luggage requirements
  • Accessibility or mobility requirements
  • Special transportation requests
  • Other information reasonably necessary to provide the service

ETOHI is not responsible for delays, additional charges, service limitations, or inability to provide requested services resulting from inaccurate, incomplete, or changed information provided by the Booking Party or Passenger.

3. PRICING & PAYMENT

The Booking Party is responsible for payment of the applicable price and any charges properly applicable to the reservation. Pricing may vary depending upon the vehicle, service type, duration, date, time, locations, itinerary, number of Passengers, special requests, and other factors applicable to the reservation.

Additional charges may apply when services extend beyond the original reservation or when charges are otherwise authorized or applicable under these Terms.

ETOHI may require payment or a valid payment method before providing services.

4. CANCELLATION & REFUND POLICY

4.1 Cancellations 24 Hours or More Before Service
Reservations cancelled at least 24 hours before the scheduled service time are eligible for a 100% refund, subject to any non-refundable third-party charges that were disclosed at the time of booking.

4.2 Cancellations Less Than 24 Hours Before Service
Cancellations made less than 24 hours before the scheduled service may be subject to a cancellation fee of 50% of the applicable reservation charge.

4.3 No-Shows
A Passenger or Booking Party who fails to appear at the designated pickup location at the scheduled time may be considered a no-show and no refund may apply.

4.4 Termination Due to Conduct
When service is terminated because of a Passenger’s or Booking Party’s conduct, the reservation may be treated as cancelled by the Booking Party or Passenger and may be non-refundable, to the extent permitted by applicable law.

5. ITINERARY & SCHEDULE CHANGES

ETOHI itineraries are provided for planning and informational purposes. ETOHI does not guarantee that attractions, destinations, roads, facilities, venues, activities, or other locations will remain open, accessible, available, or operational.

Availability may be affected by weather, construction, traffic, government restrictions, capacity limitations, private events, maintenance, operating decisions, emergencies, or circumstances beyond ETOHI’s reasonable control.

The Booking Party and Passengers are responsible for confirming hours of operation, admission requirements, reservations, closures, restrictions, and other requirements directly with the applicable attraction, venue, business, or service provider.

ETOHI may reasonably modify, delay, reroute, or adjust an itinerary when necessary because of safety concerns, traffic, weather, road conditions, closures, emergencies, or operational requirements.

6. SERVICE TIME & OVERTIME

ETOHI services are provided for the amount of time specified in the reservation.

If a Passenger or Booking Party requests or causes the service to continue beyond the reserved service period, an overtime charge of $120 per hour may apply. The overtime rate is non-prorated. Any portion of an additional hour may be charged as a full additional hour.

ETOHI may decline additional service time based on vehicle availability, driver scheduling, safety considerations, legal requirements, or operational limitations.

7. PASSENGER CONDUCT

Passengers and Booking Parties are expected to behave respectfully and safely toward ETOHI drivers, employees, contractors, other Passengers, members of the public, private property, public property, and the communities and places visited during the service.

ETOHI may refuse or terminate service when a Passenger or Booking Party engages in conduct that is:

  • Threatening or violent
  • Abusive or harassing
  • Discriminatory
  • Unsafe
  • Seriously disruptive
  • Unlawful
  • Destructive
  • Intentionally disrespectful toward people, communities, cultural practices, or places
  • Otherwise incompatible with the safe and lawful operation of the service

ETOHI may contact law enforcement or other appropriate authorities when reasonably necessary. Any Passenger whose conduct results in termination of service may be responsible for arranging and paying for alternate transportation.

No refund is guaranteed when service is terminated because of Passenger or Booking Party conduct, subject to applicable law.

8. ALCOHOL, SMOKING, VAPING & ILLEGAL SUBSTANCES

Passengers and Booking Parties are responsible for complying with all laws applicable to their possession or consumption of alcohol.

Smoking and vaping are strictly prohibited inside all ETOHI vehicles.

Passengers must comply with all applicable federal, state, and local laws concerning alcohol and controlled substances.

ETOHI may refuse or terminate service if the possession or use of alcohol or controlled substances creates a safety concern, violates applicable law, damages property, or interferes with the safe and orderly provision of service.

9. CHILDREN & MINORS

The Booking Party must inform ETOHI when children or minors will be transported.

The Booking Party and accompanying adults are responsible for complying with applicable child passenger safety requirements and for providing required child safety seats or equipment unless ETOHI has specifically agreed in writing to provide such equipment.

Parents, guardians, and accompanying adults remain responsible for the supervision and safety of minors in their care.

10. LUGGAGE & PERSONAL PROPERTY

Each Passenger is responsible for their luggage, personal belongings, valuables, and other property.

Passengers should not leave valuables unattended in vehicles or at destinations.

ETOHI is not responsible for loss, theft, or damage to personal property except to the extent responsibility cannot lawfully be excluded or limited.

Lost property should be reported to ETOHI as soon as reasonably possible.

11. PROPERTY DAMAGE & EXCESSIVE CLEANING

To the extent permitted by applicable law, the Booking Party and/or responsible Passenger may be financially responsible for reasonable costs resulting from damage to an ETOHI vehicle or other ETOHI property caused by the Passenger.

Examples may include:

  • Physical damage to the vehicle
  • Excessive cleaning
  • Spills or stains
  • Vomit or other bodily fluids
  • Damage to seats, flooring, windows, fixtures, or equipment
  • Extraordinary cleaning or repair

ETOHI may charge a payment method provided by the Booking Party for documented and reasonable charges properly attributable to the Passenger’s conduct.

12. ACCESSIBILITY & SPECIAL REQUESTS

ETOHI will make reasonable efforts to accommodate accessibility and special transportation requests when accommodations are available and required by applicable law.

The Booking Party should notify ETOHI as early as possible regarding:

  • Mobility limitations
  • Wheelchairs or mobility devices
  • Service animals
  • Additional luggage
  • Medical equipment
  • Special seating requirements
  • Other transportation-related requirements

Vehicle type, capacity, equipment, or operational limitations may affect the accommodations available for a particular reservation.

13. SERVICE ANIMALS & PETS

Service animals may be accommodated as required by applicable law.

Non-service animals may be subject to ETOHI’s animal policies and may require advance notice.

ETOHI may establish reasonable requirements relating to animal safety, cleanliness, vehicle suitability, and advance notice to the extent permitted by law.

14. WEATHER, EMERGENCIES & UNFORESEEN EVENTS

ETOHI services may be affected by circumstances including, but not limited to:

  • Severe weather
  • Flooding
  • Road closures
  • Traffic
  • Accidents
  • Natural disasters
  • Government restrictions
  • Emergencies
  • Construction
  • Vehicle or equipment problems
  • Road or destination conditions
  • Other unforeseen circumstances

ETOHI may delay, modify, reroute, reschedule, or cancel services when reasonably necessary for safety, legal compliance, or operational reasons. ETOHI will make reasonable efforts to communicate material changes when circumstances permit.

15. ASSUMPTION OF INHERENT RISKS

Transportation and visits to various locations inherently involve ordinary risks, including traffic, road conditions, weather, delays, vehicle movement, boarding and exiting vehicles, uneven surfaces, and conditions at destinations.

Each Passenger acknowledges the ordinary and inherent risks associated with transportation and agrees to exercise reasonable care for their own safety and the safety of others.

Nothing in these Terms is intended to waive, release, or limit any right, claim, or liability that cannot legally be waived, released, or limited.

16. LIABILITY

To the fullest extent permitted by applicable law, ETOHI is not responsible for losses, delays, inconveniences, or damages resulting from circumstances beyond ETOHI’s reasonable control.

Nothing in these Terms excludes or limits liability that cannot legally be excluded or limited.

Nothing in these Terms releases ETOHI from liability where such a release is prohibited by applicable law.

ETOHI is not responsible for the acts, omissions, availability, hours, closures, conditions, policies, or services of independent third-party businesses, attractions, venues, activities, or service providers.

17. RESPONSIBILITY FOR PASSENGER CONDUCT & DAMAGE

The Booking Party and each Passenger are responsible for complying with these Terms and applicable laws.

To the fullest extent permitted by law, the Booking Party and/or responsible Passenger may be responsible for reasonable losses, costs, or expenses resulting from:

  • Violation of these Terms
  • Intentional misconduct
  • Unlawful conduct
  • Damage to ETOHI property
  • Excessive cleaning
  • Other conduct for which the Booking Party or Passenger is legally responsible

Nothing in this section requires a Booking Party or Passenger to assume responsibility for ETOHI’s own negligence, intentional acts, or other liability to the extent such responsibility cannot legally be imposed.

18. PHOTOGRAPHY & VIDEO

ETOHI may take photographs or video recordings during services for legitimate business purposes, including promotional materials, advertising, website content, printed materials, social media, and marketing.

Where permitted by applicable law, use of ETOHI services constitutes consent to the use of photographs or video in which a Passenger appears for these purposes without additional compensation.

A Passenger who does not wish to be intentionally included in promotional photographs or video should notify ETOHI in writing.

ETOHI will not knowingly use photographs or video in a misleading or defamatory manner.

19. PRIVACY

ETOHI’s collection, use, sharing, and protection of personal information are governed by the ETOHI Privacy Policy, which is incorporated into these Terms by reference. Customers should review the Privacy Policy before using ETOHI services or this website.

20. CREDIT CARD & PAYMENT AUTHORIZATION

Providing a payment method for a reservation authorizes ETOHI to process the charges expressly applicable to that reservation and authorized under these Terms.

Depending upon the reservation and applicable circumstances, charges may include:

  • The agreed reservation price
  • Overtime charges
  • Applicable cancellation charges
  • No-show charges
  • Reasonable property-damage charges
  • Reasonable excessive-cleaning charges
  • Other charges disclosed or authorized in connection with the reservation

ETOHI may provide documentation or an explanation of additional charges upon reasonable request.

Payment authorization does not authorize ETOHI to impose charges that are prohibited by applicable law or unrelated to the reservation or services provided.

For online bookings, ETOHI may provide a separate payment authorization or checkout acknowledgment in addition to these Terms.

21. THIRD-PARTY SERVICES

ETOHI may transport Passengers to or from independent businesses, attractions, venues, activities, hotels, airports, restaurants, and other destinations.

Unless expressly stated otherwise, ETOHI does not own, control, operate, or guarantee the services provided by independent third parties.

The Booking Party and Passengers are responsible for complying with applicable third-party terms, schedules, admission requirements, reservation requirements, cancellation policies, and conditions.

22. THIRD-PARTY AVAILABILITY

ETOHI does not guarantee the availability, operating hours, admission, reservations, capacity, pricing, or continued operation of third-party businesses, attractions, venues, activities, or service providers.

Third-party information may change without notice. Passengers and Booking Parties should verify important information directly with the applicable third-party provider.

23. INTELLECTUAL PROPERTY

All content on this website — including text, graphics, logos, and images — is the property of ETOHI or its respective licensors. All images on this website are the exclusive property of ETOHI or their respective owners unless otherwise noted. Unauthorized use, reproduction, distribution, or modification of any content or images without the express written consent of ETOHI is strictly prohibited. For licensing or permission requests, contact ETOHI using the information in Section 30.

24. GOVERNING LAW

These Terms and all claims or disputes arising out of or relating to them shall be governed by, construed, and enforced strictly in accordance with the laws of the State of Hawaii, without regard to any conflict-of-law principles. The application of any alternative state, federal, or international laws is hereby expressly waived and excluded to the maximum extent permitted by law.

25. VENUE

To the extent permitted by applicable law, legal proceedings arising from or relating to these Terms or ETOHI services shall be brought in a court of competent jurisdiction located in the City and County of Honolulu, Hawaii.

26. SEVERABILITY

If any provision of these Terms is determined to be unlawful, invalid, or unenforceable, that provision shall be limited or modified to the minimum extent necessary to make it enforceable, if permitted by law. The remaining provisions shall continue in full force and effect.

27. NO WAIVER

ETOHI’s failure to enforce any provision of these Terms does not constitute a waiver of ETOHI’s right to enforce that provision or any other provision in the future.

28. ENTIRE AGREEMENT

These Terms, the applicable reservation and booking confirmation, payment terms, the Privacy Policy, and any additional written terms expressly incorporated into the reservation constitute the agreement between ETOHI and the Booking Party regarding the applicable services.

29. CHANGES TO THESE TERMS

ETOHI may update or modify these Terms from time to time. Unless otherwise required by law or expressly agreed, the version of the Terms accepted by the Booking Party at the time of booking will generally govern that reservation. The most current version will be made available on the ETOHI website.

30. ELECTRONIC ACCEPTANCE & CONTACT

Where permitted by applicable law, clicking an acceptance checkbox, submitting a reservation, authorizing payment, or otherwise electronically accepting these Terms constitutes acceptance of these Terms. The Booking Party represents that they have authority to make the reservation and accept these Terms for themselves and, where applicable, on behalf of the Passengers included in the reservation.

31. BOOKING ACKNOWLEDGMENT

By making a reservation with ETOHI, the Booking Party acknowledges that they have had an opportunity to review these Terms and agrees to them to the fullest extent permitted by law. The Booking Party is responsible for communicating applicable booking requirements and these Terms to the Passengers included in the reservation.
